These Terms and Conditions ("Terms") govern your use of the MyStat Emergency Notification Program ("Program" or "Service"). By using the Service, you agree to these Terms.
Program Name: MyStat Emergency Notification Program.
MyStat is a transactional emergency and status notification service. Users pre-configure trusted contacts and approve delegates who may send status updates on the user's behalf. Messages are sent only when a user or an approved delegate explicitly triggers an update. The Service is not a recurring subscription; it is used on an as-needed basis for emergency and status communications.
Before any contact receives SMS messages from the Service, the following applies:
Users are responsible for ensuring that they have appropriate authorization to designate a contact prior to sending an invitation.
Message frequency varies and depends entirely on user-triggered or delegate-triggered status updates. Messages are not sent on a fixed schedule and are not recurring subscriptions. The number of messages a contact receives depends on how often the user or delegate sends updates.
Message and data rates may apply. Charges may vary by carrier and plan. You are responsible for any charges imposed by your carrier.
To opt out of SMS messages at any time, reply STOP to any SMS message from the Service. After you opt out, you will not receive further SMS messages unless you opt in again. For assistance, reply HELP to any SMS message or contact support@mystat.app.
For questions or support, contact us at support@mystat.app.
The Service is a communication tool only. It does not provide medical advice, emergency response services, or professional care. Do not rely on the Service as a substitute for emergency services (e.g., 911) or professional medical or legal advice.
To the fullest extent permitted by applicable law, MyStat and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or use, arising out of or in connection with the Service or these Terms. We do not guarantee delivery of messages; delivery depends on carriers, recipient devices, and network conditions. Our total liability for any claims arising from or related to the Service or these Terms shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.
We reserve the right to modify these Terms at any time. We will indicate the date of the last update. Continued use of the Service after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
These Terms are governed by the laws of the United States. Any disputes arising from or relating to these Terms or the Service shall be resolved in accordance with the laws of the United States and in the courts located therein.
